Driver Wins £20,500 for Crash Caused by Farm Waste

A motorist who crashed due to farm waste on the road has been offered £20,500 in compensation for the injuries he suffered.

The accident occurred when he drove around a blind corner and ran into a patch of mud and manure that had fallen from a vehicle from a nearby farm. He lost control of the car, which skidded off the road and overturned.

A member of the public summoned the emergency services and the driver, who had been knocked unconscious, was taken to hospital, where he was found to have sustained knee and ankle injuries as well as a badly fractured wrist. After receiving treatment for his injuries, he underwent physiotherapy, but still suffers ongoing problems. He also has flashbacks to the accident and has developed a fear of travel.

The owners of the farm initially denied any liability for the accident, even though the motorist had been driving within the speed limit and no sign had been put in place to warn of the impending hazard on the road. They later made an offer of compensation, but this was rejected as not being commensurate with the seriousness of the injuries suffered by the driver of the car, the resulting disruption to his life and the expenses incurred.

Once court proceedings had been commenced, however, a revised offer of compensation was made and accepted.
